1. Acceptance of Terms

By accessing or using the Application, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must uninstall the Application and discontinue use immediately.

2. Description of the Application

Gym Timer: Rest & Get Ready is a gym rest timer designed to help you manage rest periods between exercise sets. The Application provides the following features:

• Rest timer with visual states (Chill, Get Ready, Go) and F1-style semaphore countdown
• Smart pre-alerts — configurable audio and vibration warnings before the timer ends (5–60 seconds)
• Time presets — quick-select rest durations with customizable preset slots
• Rep and cycle counter — automatic tracking of completed sets
• Custom sounds — built-in alert sounds and the ability to load your own audio files
• Theme customization — configurable accent and background colors
• Live Activity & Dynamic Island (iOS 16.1+) — timer visible on the Lock Screen without unlocking
• Apple Watch companion app — standalone or synced timer on your wrist
• Home Screen widget — quick-start timer from your device home screen
• Multi-language support — English, Italian, Spanish, German, French, and Portuguese

3. User Eligibility

The Application is not directed to children under 13 years of age. By using the Application, you represent that you are at least 13 years old. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. License and Restrictions

The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on devices you own or control, in accordance with these Terms and the applicable app store terms.

You agree not to:

• Copy, modify, reverse-engineer, decompile, or disassemble the Application or its source code
• Redistribute, sublicense, lease, rent, or lend the Application to third parties
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the Application for any unlawful or unauthorized purpose
• Attempt to circumvent any security features, access controls, or usage limitations
• Interfere with or disrupt the operation of the Application or its associated services

5. Advertising

The Application is provided as an ad-supported service. Advertisements are displayed via Google AdMob and may include banner ads, interstitial ads, rewarded ads, and app-open ads.

By watching a rewarded ad, you may receive a temporary ad-free experience (currently 90 minutes). Ad frequency, formats, and reward durations are subject to change without prior notice.

Ad content is provided by third-party ad networks and is not controlled by the Service Provider. The Service Provider is not responsible for the content, accuracy, or availability of third-party advertisements.

6. In-App Purchases, Subscriptions, and Premium

The Application offers optional premium upgrades to remove ads and unlock additional features. The following purchase options are available through the Apple App Store:

Auto-Renewable Subscription

• Rest Timer Pro — Annual: An auto-renewable subscription billed at $9.99/year (price may vary by region). Includes a 1-week free trial for first-time subscribers.

Subscription details:

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless canceled at least 24 hours before the end of the current billing period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions by going to your device Settings → Apple ID → Subscriptions.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.

One-Time Purchase

• Rest Timer Pro — Lifetime: A one-time, non-consumable purchase at $22.99 (price may vary by region). No recurring charges.

Premium Features

Both options unlock the same set of premium features:

• Complete removal of all advertisements (banner, interstitial, rewarded, app-open)
• Unlimited timer presets (versus 3 in the free version)
• All Live Activity lock-screen preset slots (versus 1 in the free version)
• Custom completion sounds
• Unlock more timers on Apple Watch

All purchases are processed and managed by Apple through the App Store. The Service Provider uses RevenueCat to manage purchase verification and entitlements. Refund requests must be directed to Apple, in accordance with their refund policy.

The Service Provider does not store credit card information or process payments directly.

7. User Content

The Application allows you to load custom audio files from your device for use as timer alerts. These files remain stored locally on your device and are not uploaded, shared, or transmitted to any server.

You are solely responsible for ensuring that any audio files you load comply with applicable copyright and intellectual property laws.

8. Data and Privacy

Your use of the Application is also governed by our Privacy Policy, which describes how information is collected, used, and shared.

The Application does not require account registration. All user preferences (timer settings, theme colors, sound choices, language selection) are stored locally on your device. No personal data is transmitted to the Service Provider's servers.

9. Apple Watch and Wearable Devices

The Application includes a companion app for Apple Watch (and experimental support for Wear OS). Timer settings are synced between your phone and wearable device via local connectivity services.

The wearable companion app is provided "as is" and its functionality may vary depending on your device model, operating system version, and connectivity conditions.

10. Notifications and Background Features

The Application may send local notifications to alert you when the timer is about to end or has ended. Notifications require your explicit permission and can be disabled at any time through your device settings.

Features such as Live Activity and Dynamic Island require iOS 16.1 or later and may not be available on all devices.

11. Intellectual Property

All rights, title, and interest in and to the Application — including its design, code, graphics, icons, sounds, and text — are owned by the Service Provider or its licensors. The Gym Timer name, logo, and related branding are trademarks of JustCodeMobile.

Nothing in these Terms grants you any right to use the Service Provider's trademarks, trade names, or branding without prior written consent.

12. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

The Service Provider does not warrant that the Application will be uninterrupted, error-free, secure, or free of harmful components. Timer accuracy may be affected by device performance, operating system behavior, background restrictions, and battery-saving features.

13. Limitation of Liability

To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Application, including but not limited to:

• Injuries sustained during exercise or training
• Loss of data or device malfunction
• Interruption of timer alerts or notification delivery
• Actions taken based on third-party advertisement content

The Application is a fitness utility tool and is not a substitute for professional fitness, medical, or health advice. Always exercise responsibly and consult a qualified professional if needed.

14. Third-Party Services

The Application integrates with the following third-party services, each governed by their own terms and policies:

• Google AdMob — Google Terms of Service
• RevenueCat — RevenueCat Terms of Service
• Google Fonts — Google APIs Terms of Service

The Service Provider is not responsible for the practices or content of any third-party services.

15. Termination

The Service Provider may terminate or suspend your access to the Application at any time, without prior notice, if you violate these Terms or engage in conduct deemed harmful to the Application or its users.

You may terminate your use of the Application at any time by uninstalling it from your device. Upon termination, all rights granted under these Terms will cease immediately.

16. Changes to These Terms

The Service Provider reserves the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Application after changes are posted constitutes acceptance of the updated Terms.

We encourage you to review this page periodically to stay informed.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Italy.
